1.0 SUBJECT TITLE: Surface Water Design Manual

1.1 EFFECTIVE DATE: The effective date of this Public Rule is January 1, 2009 or thirty days after filing with the Clerk of the Council, whichever comes later.

1.2 TYPE OF ACTION: Superseding PUT 8-3-3.

2.0 PURPOSE: To adopt an update to the 2005 Surface Water Design Manual and establish a standard procedure for reviewing the drainage plans and related material of applications for development within unincorporated King County in compliance with the Surface Water Design Manual and King County Code Chapter 9.04 (as amended by Ordinance No. 16264).

5.0 DEFINITIONS:

5.1 "Applicant" means a property owner, or any person or entity designated or named in writing by the property owner to be the applicant, in an application for a development proposal, permit, or approval.

5.2 "Development" means any activity that requires a permit or approval, including but not limited to a building permit, grading permit, shoreline substantial development permit, conditional use permit, special use permit, zoning variance or reclassification, subdivision, short subdivision, Urban Planned Development, binding site plan, site development permit, or right-of-way use permit. "Development" does not include a Class I, II, III, or IV-S forest practice conducted in accordance with Chapter 76.09 RCW and Title 222 WAC or a class IV-G nonconversion forest practice, as defined in K.C.C. chapter 21A.06, conducted in accordance with Chapter 76.09 RCW and Title 222 WAC and a county approved forest management plan.

5.3 "Drainage" means the collection, conveyance, containment, or discharge, or any combination thereof, of surface and storm water runoff.

5.4 "Surface and storm water" means water originating from rainfall and other precipitation that is found on ground surfaces and in drainage facilities, rivers, streams, springs, seeps, ponds, lakes, wetlands, and shallow groundwater.

5.5 "Surface Water Design Manual" means the manual, and supporting documentation referenced or incorporated in the manual, describing surface and storm water design and analysis requirements, procedures, and guidance that has been formally adopted by rule under the procedures in KCC 2.98. The Surface Water Design Manual will be available from the King County Department of Development and Environmental Services or the Department of Natural Resources & Parks, Water and Land Resources Division, or their successor agencies.

6.0 POLICIES:

6.1 The Surface Water Design Manual contains the King County surface and storm water design and analysis requirements, procedures, and guidance for development applications in unincorporated King County.

6.2 The Surface Water Design Manual shall be available for reading and for purchase at the Department of Natural Resources & Parks Water and Land Resources Division and the Department of Development and Environmental Services Permit Center. Viewing locations also include selected King County libraries. Electronic format is available on the King County Water and Land Resources Division website.

6.3 This Public Rule is exempted from the rule of strict construction and shall be liberally construed to give full effect to the objectives and purposes for which it was adopted.

6.4 If any provision of this Public Rule or its application to any person or property is held invalid, the remainder of the Public Rule or the application of the provision to other persons or property shall not be affected.

7.0 PROCEDURES:

Action by Action

Director, Department of Natural Resources & Parks	7.1	Reviews the Surface Water Design Manual and revises it if necessary.
Applicant	7.2	Prepares drainage plans in compliance with the Surface Water Design Manual and submits those drainage plans as part of a development application to the Department of Development and Environmental Services.
Director, Department of Development and Environmental Services	7.3	Reviews the material submitted in Step 7.2 and determines if it complies with the Surface Water Design Manual.

7.3.1 Returns inadequate material to the applicant with specific instructions to comply with the Surface Water Design Manual.

7.3.2 Forwards adequate application to be processed according to the established review process.

8.0 RESPONSIBILITIES:

8.1 The Department of Natural Resources & Parks is responsible for:

8.1.1 Identifying those development applications which should be required to comply with the Surface Water Design Manual.

8.1.2 Providing training to the general public, developers, and employees of the Department of Development and Environmental Services.

8.2 The Department of Development and Environmental Services is responsible for:

8.2.1 Implementing applicable pollution prevention best management practices.

8.2.2 Providing training to the general public, developers, and employees of the Department of Development and Environmental Services.

8.2.3 Inspecting development construction and sites for compliance with approved plans and the Surface Water Design Manual and enforcing these requirements.

8.3 The applicant is responsible, at a minimum, for:

8.3.1 Demonstrating that the development application complies with the Surface Water Design Manual.

8.3.2 Constructing and maintaining the improvements required by the approved plans and the Surface Water Design Manual.
