Tabula End User License Agreement (EULA)

NOTICE TO USER: THIS IS A CONTRACT. BY USING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS END USER LICENSE AGREEMENT.

This SOFTWARE PRODUCT has been developed for PLANNING LEVEL conveyance cost estimating for use by King County Staff and consultants with whom they chose to share this SOFTWARE PRODUCT. It is not intended, nor should be used for other purposes.

This SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

No Warranty: The SOFTWARE is being delivered to you AS IS, King County and its creators make no warranty as to its use or performance. King County AND ITS SUPPliERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESulTS YOU MAY OBTAIN BY USING THE SOFTWARE PRODUCT. King County AND ITS SUPPliERS MAKE NO WARRANTIES, TO THE MAXIMUM EXTENT PERMITTED BY APPliCABLE LAW. King County AND ITS SUPPliERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPliED, AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABIliTY, OR FITNESS FOR ANY PARTICulAR PURPOSE. IN NO EVENT WILL King County OR ITS SUPPliERS BE liABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF A King County REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBIliTY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. Some states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or the exclusion of implied warranties or limitations on how long an implied warranty may last, so the above limitations may not apply to you.

This Agreement is governed by the laws of the State of Washington.
