Transfer of Development Rights - TDR - in King County, Washington State

TDR Sending Site Application Form

You must first complete an application form for Transfer of Development Rights Program certificate and return it with the requested supporting documents to Darren Greve, 201 S Jackson St, Suite 600, Seattle, WA 98104. The fee to apply is $145; additional fees may apply up to a maximum of $550.

When all of your application materials are complete, then they will be sent to the Interagency Review Committee for review. We will also review your property title information and schedule a site visit.

If your property is applying to qualify under one of the forestry categories then you will also need to complete a Forest Stewardship Plan. The Interagency Review Committee will then make a final determination on whether or not the property meets the qualification criteria, determine the number of rights available for transfer, and develop any special conditions for the easement.

At this point you may choose to proceed with placing an easement on your property and receiving a development rights certificate for the development rights to be transferred or you may choose to wait until you have an interested buyer for the development rights before proceeding with the easement. Since an easement is a real estate transaction, there will be excise taxes that will need to be paid when the easement is recorded.
