Mandatory_eFiling_Waiver

On July 1, 2009 King County LGR 30 (b)(5) mandated that all attorneys file documents electronically with the Clerk's Office.  This rule also allows for parties to submit an application requesting a waiver to the mandatory e-filing requirement.

(D) Waiver of the Requirement to E-File.  If an attorney is unable to e-file documents, the attorney may request a waiver.  The attorney must explain why he or she needs to file paper documents in that particular case.  The Clerk will make waiver request forms available.  The Clerk will consider each application and provide a written approval or denial to the attorney.  The waiver may be for a specific case or for a specific period of time determined by the Clerk.  Attorneys who receive a waiver shall file a copy of the waiver in each case in which they file documents.  Attorneys who have received a waiver shall place the words "Exempt from e-filing per waiver filed on (date)" in the caption of all paper documents they file for the duration of the waiver.


Requesting a Waiver

  1. Obtain an application by clicking here, or in person at any Clerk's Office Location.
  2. Submit the completed application by mail or in person at any counter at any Clerk's Office location.
  3. Once the application is submitted you are exempt from filing electronically until the application has been processed and you have received the response from the Clerk's Office.
  4. You are required to include the language, "exempt from e-filing per application pending waiver filed on (date)" in the caption of all subsequent paper form filings until you have received a response from the Clerk's Office.


Application Review Process

The Clerk's Office will send a response to the applicant within two weeks of receipt of the waiver request.

  • If Approved:
    • The response will instruct you to file copies of the response in each case where a waiver is requested.
    • The response will also instruct you to include language on filings as specified in LGR 30 on all subsequent filings for the duration of the waiver period.  If you do not include this language on subsequent filings you may be assessed a fee.
  • If Denied:
    • You can appeal the decision according to the instructions below.
    • You cannot re-apply for a waiver for a period of six months from the date of the initial denial unless there has been a substantial change in your circumstances.
    • You are expected to file your documents electronically and may be assessed a fee if you continue to file your documents in paper form.


Waiver Denied Appeal Process

  1. Contact the Clerk's Office official who rendered the decision.
  2. If after speaking with the Clerk's Office official you still wish to appeal, request an appeal form.
  3. Submit your completed appeal form to the Clerk's Office Deputy Director.
  4. The Deputy Director will send a response to you within two weeks of receipt of appeal document.
  5. You are exempt from filing electronically until your appeal has been processed.  You are required to include the language, "exempt from e-filing per application pending waiver filed on (date)" in the caption of all subsequent paper form filings until you have received a response to your appeal from the Clerk's Office Deputy Director.
