June 2, 2009 PAO's "RBI" Project Recent Examples of Prolific BurglarsMartin Huber, 08-1-012528-5 SEA.King County Case: Arrested November 20, 2008, after a neighbor of the victim found the defendant half-way through an apartment window. The defendant had burglary tools and a backpack full of property that had been stolen from other apartments in the complex. Two other apartments in the complex had been burglarized on November 19. The defendant had pawned some of the property from the November 19th burglary shortly after the burglary occurred. Based on the above information the State filed Attempted Residential Burglary charges. Huber was arrested on December 1, 2008, in Snohomish County while committing a residential burglary. It was discovered in the course of that arrest that Huber was in possession of jewelry that had been stolen during a burglary in King County. Snohomish County Cases: Huber currently has three Residential Burglary charges pending in Snohomish County Superior Court with offense dates in October and November of 2008. In two cases, the victims came home to find Huber in their house. One detained him until police arrived. On February 1, 2009, Huber was arrested for shoplifting at a Fred Meyer store in Everett; he was stealing a crow bar and a screw driver. Snohomish County has indicated that there are additional Possession of Stolen Property (PSP) and Trafficking charges that can be added, as well as additional Residential Burglary cases that Huber may be charged with. John Forbes, 08-1-13365-2 and 09-1-00767-1.He plead guilty as charged last week to two counts of residential burglary with the aggravating factors (occupied residence and "free crimes") with an agreed exceptional sentence of 10 years (Statutory maximum for residential burglary. In his 2006 residential burglary conviction, he entered another woman's home through her garage. She woke up with him standing at the foot of her bed holding a flashlight. Both of these cases involved entering homes occupied by single women: On December 11, 2008 in Bothell, the defendant broke into home of a woman and her 11-year-old daughter, both of whom were home sleeping at the time, at 1:15 a.m. A neighbor saw him park his car by the house prior to the burglary. The neighbor contacted police who arrived and caught the defendant as he attempted to flee. On December 18, 2008 in Bothell, the defendant broke into the home of a woman as she was sleeping. She woke up at 3 a.m. to see him in her bedroom. He fled. K-9 police tracked him. He confessed post Miranda. Both cases were charged up front as residential burglaries. The defendant's criminal history score is an 11, making his range 63-84 months. In both cases, the State added the "multiple offenses going unpunished" aggravator (RCW 9.94A.535(2)(c)) and the "victim present in the residence when crime committed" aggravator (RCW 9.94A.535(3)(u). The defendant's criminal history is as follows:
